According to the Constitutional Court's decision, the Pasaman Regency KPU must hold a re-vote for the Pasaman Pilkada within 60 days of the decision coming into effect.

PADANG, KOMPAS - The West Sumatra General Election Commission is waiting for a letter from the KPU regarding the stages and schedule for the re-voting of the Pasaman Regency Pilkada. Previously, the Constitutional Court disqualified the elected Pasaman Deputy Regent candidate, Anggit Kurniawan Nasution, and ordered a re-vote.
Head of the Socialization, Voter Education, Community Participation, and HR Division of the West Sumatra KPU Jons Manedi, Monday (24/2/2025), said that his party complied with the Constitutional Court (MK) decision regarding Anggit's disqualification and would immediately follow up on the MK's order to hold a PSU.
"The follow-up from the West Sumatra KPU, of course, first, is to identify budget issues because the PSU needs a budget. Second, the West Sumatra KPU and Pasaman KPU are waiting for a letter from the Indonesian KPU regarding the stages and schedule for the implementation of the PSU," said Jons.
Jons continued, according to the Constitutional Court's decision, the PSU for the Pasaman Pilkada will be held in all TPS using the DPT, DPTB, and DPK in the Simultaneous Pilkada on November 27, 2024. The Constitutional Court's decision also asked the political parties supporting candidate number 1 to submit a new deputy candidate to accompany Welly Suheri in the PSU.
"The Constitutional Court's decision must be followed up within 60 days of its decision," said Jons.

Pasaman Regency KPU Chairman Taufiq said he was ready to implement the Constitutional Court's decision to hold a PSU. For technical matters, his party will consult with the West Sumatra KPU and the KPU. As for the budget, according to the Election Law, the Pilkada budget is the responsibility of the regional government.
"The Pasaman Regency KPU will coordinate directly with the regional government regarding the budget needed to run the PSU after the Constitutional Court's decision," said Taufiq.
Previously, the Constitutional Court in decision Number 02/PHPU.BUP-XXIII/2025 granted part of the petition from candidate pair number 2 of the Pasaman Pilkada, Mara Ondak and Desrizal. The respondent in this case is the Pasaman Regency KPU, while the related parties are candidate pair number 1 Welly Suher and Anggit Kurniawan Nasution.
"Adjudicating, in the main petition: Granting the Petitioner's petition in part," said Chief Justice Suhartoyo reading the verdict, in a press release, Monday. One of the points of this verdict is to disqualify Anggit.
In its considerations, the Constitutional Court assessed that Anggit did not fulfill the provisions of Article 7 Paragraph (2) letter g of Law Number 10 of 2016 concerning the Election of Governors, Regents and Mayors (Kompas.id, 24/2/2025).

This article regulates the statement of never having been a convict based on a court decision that has obtained permanent legal force or for former convicts who have openly and honestly stated to the public that the person concerned is a former convict.
"Therefore, this has violated or injured the principles of holding regional head elections that are fair, democratic, and have integrity. Thus, in order to ensure and guarantee the legitimacy of the results of the 2024 Pasaman Regent and Deputy Regent elections that are fair, democratic, and have integrity, there is no doubt for the Court to disqualify the candidate for deputy regent Anggit Kurniawan Nasution as a candidate for Deputy Regent of Pasaman Regency in 2024," said the Court.
In another case, the Constitutional Court also rejected the lawsuit filed by the Daliyus-Heri Miheldi candidate pair for the West Pasaman Pilkada. Based on the Constitutional Court's decision, the KPU will send a letter to the West Pasaman KPU to determine the candidate pair number 1, Yulianto-M Ihpan as the elected candidate pair for Regent and Deputy Regent of West Pasaman within three days of the decision.
"After being determined by the KPU, the candidate pair is proposed to the DPRD for a plenary session. Later, the DPRD proposes to the Ministry of Home Affairs for the inauguration process," said Jons.
